In order to Enforce a Judgment in the state of Alabama, you must adhere to the following protocol:

  • Record Your Judgment – You should obtain a certificate of judgment through the circuit clerk’s office and file it with the probate office of Calhoun County or the appropriate court of record. By law, you cannot pursue your judgment until the time for appeal has expired—14 days in district court or 42 days in circuit court.

Once the time for appeal has passed, attorney Turner can pursue your claim via the following methods:

  • Executing on Real Property – If the debtor owns property in multiple counties, it’s important that your lawyer files the judgment in all counties where property is owned. If the defendant owns real property, you can enforce your judgment by levying and executing on the property. That is, the property will be sold at the courthouse to settle your claim. You may also execute on personal property.
  • Garnishment of Wages or Bank Accounts – If the debtor has income, it is possible for your attorney to file for wage garnishment to settle the judgment or he may file a garnishment against the bank account of the debtor. The debtor’s employer can be compelled to pay up to 25% of his or her wages into a collection account until the debt is settled.
  • Post-Judgment Discovery – In order to pursue a claim, it is often necessary to find out what assets and income the debtor has available. This allows attorney Turner to discover which avenues to pursue.
