Before you can close on any Alabama real estate transaction, a title search must be conducted. A title search determines whether the person selling the property is the actual true owner and has the right to sell it — and that the buyer is receiving all the rights to the property that they’re paying for.

The title search involves several steps, and your Alabama title company performs this search for you.

• Chain of Title. The chain of title is simply the history of the ownership of the property. It’s a public record of who bought it, who sold it, and when.

• Tax Search. This determines the status of the taxes on the piece of property. The search finds out if the taxes are up to date or if any are unpaid or past due. A tax search can also reveal if there are any special assessments — such as liens — against the property.

• Report on Possession. Inspectors look at the property to verify the lot size, check the location of any improvements, and look for evidence of easements that may not be shown on record. • Judgment and Name Search. During the title search, it’s also important to make sure there are no unresolved judgments (liens) against the seller or any previous owners of the property. If the seller has a similar name to a previous owner with a judgment against them, this can affect the sale, and the seller must resolve the issue.
